Terms and Conditions

MILLENNIUM TRAINING TERMS OF AGREEMENT

This Agreement is made between YOU (business owner or manager) and Millennium Training Inc.  By clicking “I ACCEPT” or by or using the Millennium Training Materials (defined below), YOU accepts the terms of this AGREEMENT.  If YOU do not agree to the terms of this AGREEMENT, click the “CANCEL” button.

GRANT OF LICENSE TO MILLENNIUM TRAINING MATERIALS

Subject to the terms of this AGREEMENT, MILLENNIUM TRAINING hereby grants to YOU a nonexclusive, worldwide right to use all or any part of the following training materials for 1 LOCATION ONLY. This is not for use in multiple locations or for you to use for consulting other businesses.

  • Millennium Training Small School Big Profit Materials
  • Millennium Training Business & Marketing Strategies
  • Millennium Training Instructor Training Program & Videos
  • Millennium Training Personal Achievement Academy Programs, Events, Booklets, School Talk Program and monthly Character Development Handouts
  • Curriculum Design Materials & Videos
  • Webinar Training Lessons & Materials

YOU may use Millennium Training programs and related marketing materials provided to YOU to create and market Your school workouts, special events, challenges and contests.  Modifications of Millennium Training special event posters and marketing materials are limited only to the addition of your business mark, contact information and or date of special events. Modification to any video media commercials is strictly prohibited. You may not change, alter or use any spokesperson, talent, model’s name or picture.

TERMS OF MEMBERSHIP:

As a Subscriber to the Millennium Training website, you are allowed all access to the website curriculum for the terms of enrollment.

Millennium Training Enrollment, Length of Agreement and Payments

There are 2 memberships available. Initial enrollment length of the Millennium Training program is your choice of:

1: Month to Month Membership: the 30 day membership is $125 per month with automatic renewal every month until the account is cancelled.

2: 6 Month Membership: the 6 month minimum agreement for $99 per month with automatic renewal every month after the 6 months until the account is cancelled. There is a NO CANCEL ALLOWANCE on the 6-month agreement until after the 6 month agreement is fulfilled. Initial payment is made at enrollment and License fees/payments are automatically drawn every 30 days from the date enrolled.

Cancellation of Agreement

You must provide a 30-day cancellation notice by:

  1. Canceling the membership online at Millennium Training (Account Page)

Millennium Training personnel are not responsible for canceling agreement online. You are responsible for making the last payment during this 30-day cancellation period. You will have full access to all materials for 30 days after the final payment. Your account and subscription membership will be turned off 30 days from final payment.

Termination of Millennium Training Subscription

All benefits of the agreement to use Millennium Training materials are terminated immediately if subscription fee is delinquent or any part of this agreement is violated. You have 30 days to stop using and completely remove all trademarked Millennium Training materials, names, marks, posters and marketing materials from location and advertising strategies. You are responsible for any payments due during this 30-day period.

Misuse of Agreement, Name and Mark

You may not use the Millennium Training Name or Mark:

  • In your corporate or legal name
  • To incur or fulfill an obligation or indebtedness
  • In any manner that is inconsistent with provisions of the agreement without the express written consent of Millennium Training
  • To identify yourself, business or legal fiction as the owner of Millennium Training or any employee of Millennium Training.
  • Failure to identify yourself as a “subscriber” on any invoices, forms, business stationery, receipts, or other printed material used in the operation of your business.

Limitation of Liability

MILLENNIUM TRAINING’S MAXIMUM LIABILITY TO YOU UNDER ANY CIRCUMSTANCES IS LIMITED TO THE AMOUNT OF THE MEMBERSHIP FEE YOU PAID FOR THE MEMBERSHIP.

General

This Agreement:  (a) is severable; and (b) is binding on permitted successors and assigns. In any dispute arising out of or relating to this agreement, the substantially prevailing party shall be entitled to its reasonable attorneys’ fees. No modification or waiver of this agreement will be binding unless made in a writing signed by Millennium Training and one duly authorized representatives.  No failure by MT to exercise a right or remedy shall be deemed a waiver of any further right or remedy.

This privacy statement is applicable to Millennium Training content contained therein, and all services and forums provided thereon.

MT respects the privacy concerns of all users of Millennium Training. Millennium Training also recognizes the valuable potential of technology to help people communicate with the companies whose web sites they visit, particularly through customer databases. Responsible use of the information you share with Millennium Training is paramount. In order to help you understand how the information you provide Millennium Training will be used, we has created and implemented the following guidelines.

Your Personal Information

We will not give any of your personal information to any third party without your express approval. The only personal information we will ask you if you want us to share with third parties is your name and e-mail address. If you don’t want us to share your name and e-mail address, you can tell us that by clicking on “No” in the box at the time you register as a member on Millennium Training or each time we request information from you or at other points. We sometimes share aggregated (not personal) information with third parties about our user base, but that information does not include any individually identifiable material.

Sweepstakes and Joint Promotions: On occasion, we conduct various sweepstakes, contests and joint promotions with third parties. In those instances, we will specifically notify you of the intended use of your personal information, the relevant third party, and give you the opportunity to permit or preclude your personal information from being used.

What are “Cookies” and how are they used?

Cookies are small files that may be downloaded to your computer to help the operator of a web site understand your usage patterns on that site. They may also improve the performance of a site for an individual by storing on your computer such items as user passwords, computer configuration, browser type, etc.

Most browsers are set to accept cookies without any action required by the user. You can alter that default setting by clicking the help button and following the instructions for your browser. However, if you set your browser not to accept cookies, some parts of The MT may not work correctly for you.

FOR KIDS

If you are under 18 years of age, you need to let your parent or guardian know about Millennium Training’s privacy policy and get his/her permission before giving us any of your personal information, even information required for registration to use Millennium Training.

If you win a contest that has a prize, your parent or guardian will have to mail or fax us a signed note at the address or fax number listed in the rules for the specific contest that says it was OK for you to enter, and tells us they will accept the prize for you.

You will be told to ask a parent before you pay for anything on Millennium Training if you are under 18. (If you buy anything online, you or your parents may send it back within thirty days if you don’t open it.) Some areas of this web site may have special rules for children under the age of 18. When you are in those areas you must follow those rules.

FOR PARENTS

Parents or guardians are encouraged to spend time online with their children to become familiar with the types of content available on The Millennium Training and the Internet in general. Parents should regularly oversee their children’s use of e-mail and other online communications and transactional features. Control tools are available from online services and software manufacturers that can help provide a safe online environment for kids. You can find out about software that protects your children at the Direct Marketing Association’s home page at: http://www.the-dma.org. If your child has used your credit card on The Millennium Training without your permission, contact us immediately.

If a child has provided us with personally identifiable information, a parent or guardian of that child should contact us if he/she would like this information deleted from our records. We will use reasonable efforts to delete the child’s information from our existing files.

You agree not to do any of the following while on Millennium Training:

  1. transmit any message, information, data, text, software or graphic files, or other materials (“Content”) that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, that may be invasive of another’s right of privacy or publicity, hateful, racially, ethnically or otherwise objectionable;
  2. impersonate any person or entity.
  3. intentionally or unintentionally violate any applicable local, state, national or international law, rule or regulation; and
  4. upload or transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights (“Rights”) of any party.

By submitting (e.g., uploading or transmitting) Content to a Millennium Training Feature, you automatically grant Millennium Training the royalty-free, perpetual, irrevocable, non-exclusive, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. In addition, you warrant that any and all so-called “moral rights” in the Content have been waived.

Millennium Training and its designees shall have the right, but not the obligation, in their sole discretion to edit, refuse to post, or remove any Content posted in any Millennium Training Feature. Without limiting the foregoing, Millennium Training and its designees shall have the right to remove any Content that is in violation of the provisions hereof or otherwise objectionable. You agree to indemnify and hold Millennium Training harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your violation of these terms and conditions or your violation of any rights of another.
